These Terms of Use (“Terms”) govern your access to and use of https://jeffcohomepros.com and the contractor-referral services offered by JeffCo Home Pros (“JeffCo Home Pros,” “we,” “us,” or “our”).

By visiting our website, submitting a service request, requesting a contractor referral, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website or our referral services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use our contractor-referral services.

If you use the website on behalf of a company, property owner, landlord, homeowners association, or another person or entity, you represent that you have authority to act on that party’s behalf.

2. Contractor-Referral Service

JeffCo Home Pros operates a contractor-referral and lead-coordination service. We help homeowners, businesses, property managers, and other customers connect with independent contractors and home-service providers.

JeffCo Home Pros is not the contractor performing the work unless we expressly agree otherwise in a separate written agreement.

Our services may include:

• Receiving and reviewing service requests
• Identifying contractors who may provide the requested service
• Sharing project information with one or more contractors
• Coordinating telephone calls, appointments, inspections, or estimates
• Following up with customers and contractors
• Collecting feedback about referral experiences

Submitting a request does not guarantee that a contractor will be available, accept the project, provide an estimate, or perform the requested work.

3. Independent Contractors

Contractors referred through JeffCo Home Pros are independent businesses. They are not employees, agents, joint venturers, partners, or representatives of JeffCo Home Pros.

Each contractor independently controls:

• Whether to accept a referral
• Scheduling and availability
• Inspections and estimates
• Pricing and payment requirements
• Materials and equipment
• Employees, subcontractors, and work methods
• Licensing, permits, insurance, and regulatory compliance
• Warranties and guarantees
• The quality, safety, timing, and completion of the work

JeffCo Home Pros does not direct, supervise, control, or warrant a contractor’s work.

4. No Endorsement or Guarantee

A contractor’s inclusion in our referral network does not constitute a guarantee or warranty concerning that contractor.

Whether or not JeffCo Home Pros has reviewed information concerning a contractor, we do not guarantee:

• Licensing or license status
• Insurance coverage
• Bonding
• Background-check results
• Qualifications or experience
• Financial condition
• Reputation or reliability
• Availability
• Pricing
• Code compliance
• Workmanship
• Safety
• Project completion
• Warranty performance

Credentials, insurance, licenses, personnel, ownership, and business conditions can change. You are responsible for independently evaluating each contractor before hiring or allowing work to begin.

5. Your Responsibility When Hiring a Contractor

Before hiring a contractor, you should take reasonable steps to protect yourself and your property. These steps may include:

• Confirming the contractor’s identity and business information
• Verifying required licenses with the appropriate licensing authority
• Requesting current proof of insurance and bonding
• Checking references, reviews, and complaint histories
• Obtaining more than one estimate when practical
• Requesting a detailed written contract
• Confirming who will obtain permits and schedule inspections
• Reviewing payment schedules, warranties, and cancellation rights
• Avoiding payment in full before satisfactory completion
• Consulting an attorney or other professional for significant projects

You are solely responsible for deciding whether to hire a referred contractor.

6. Estimates, Contracts, Payments, and Warranties

Unless JeffCo Home Pros expressly agrees otherwise in writing, all estimates, contracts, payments, deposits, financing arrangements, warranties, guarantees, change orders, and project-related agreements are directly between you and the contractor.

JeffCo Home Pros is not a party to your agreement with a contractor and is not responsible for:

• Project pricing or unexpected costs
• Deposits or payments
• Financing terms
• Materials or product selections
• Delays or missed appointments
• Change orders
• Permits or inspections
• Property damage
• Personal injuries
• Construction defects
• Code violations
• Mechanic’s liens
• Warranty claims
• Incomplete or unsatisfactory work
• Acts or omissions of contractors or subcontractors

You should read and understand all documents before signing or making payment.

7. Contractor Disputes

Any dispute concerning estimates, payments, workmanship, warranties, property damage, injuries, scheduling, or project performance is primarily between you and the contractor.

You may notify JeffCo Home Pros about a problem involving a referred contractor. We may review the complaint, request information, forward communications, restrict future referrals, or attempt to facilitate communication. However, we are not required to mediate, investigate, resolve, reimburse, or assume liability for the dispute.

Nothing in these Terms prevents you from contacting an appropriate licensing board, consumer-protection agency, insurer, law-enforcement agency, or court.

8. Service Requests and Information Accuracy

You agree to provide information that is accurate, complete, and current.

You must have authorization to request work at the property identified in your request. You may not impersonate another person, submit fraudulent requests, provide false property information, or use our service to harass contractors or other individuals.

JeffCo Home Pros may decline, suspend, or cancel a referral request at any time.

9. Authorization to Share Your Request

When you request a referral, you authorize JeffCo Home Pros to share information reasonably necessary to address your request with one or more independent contractors or service providers.

Shared information may include your:

• Name
• Telephone number
• Email address
• Property or service address
• Project description
• Preferred appointment information
• Photographs, videos, or documents
• Communications concerning the requested service

Our collection, use, and disclosure of personal information are further described in our Privacy Policy.

10. Telephone, Email, and Text Communications

By submitting your contact information and requesting assistance, you authorize JeffCo Home Pros and contractors receiving your referral to contact you about that request by telephone, email, or text message.

Communications may concern scheduling, estimates, project questions, service updates, and follow-up requests. Consent to receive promotional communications is not a condition of purchasing contractor services.

You may opt out of promotional text messages by replying STOP and promotional emails by following the unsubscribe instructions in the message. Standard telephone, messaging, and data rates may apply.

11. Emergency Situations

JeffCo Home Pros is not an emergency-response service.

Do not rely on our website or referral process for fires, suspected gas leaks, electrical hazards, flooding that presents an immediate danger, medical emergencies, crimes in progress, or other situations threatening life or property.

For emergencies, call 911, your utility provider, or the appropriate emergency authority.

12. Acceptable Website Use

You may use the website only for lawful purposes. You may not:

• Submit false, misleading, fraudulent, or unauthorized requests
• Impersonate another person or business
• Attempt to gain unauthorized access to the website or related systems
• Introduce viruses, malware, or harmful code
• Scrape, copy, harvest, or extract website data without permission
• Interfere with the website’s operation or security
• Use automated systems to send requests or access content without authorization
• Harass, threaten, or abuse customers, contractors, or our representatives
• Use the website to violate another party’s legal or intellectual-property rights
• Use information obtained through the website for spam, fraud, or unlawful solicitation

We may restrict or terminate access when we reasonably believe these Terms have been violated.

13. Website Content and Intellectual Property

The website and its content—including text, graphics, logos, branding, photographs, layouts, service descriptions, and other materials—are owned by JeffCo Home Pros or used with permission and are protected by applicable intellectual-property laws.

You may view and print reasonable portions of the website for personal, noncommercial use. You may not reproduce, republish, modify, distribute, sell, license, or commercially exploit website content without written permission.

14. Reviews, Feedback, and Submitted Content

If you submit a review, testimonial, photograph, project description, suggestion, or other content, you represent that:

• The content is truthful and based on your genuine experience
• You have the right to submit it
• It does not violate another person’s privacy or intellectual-property rights
• It is not defamatory, fraudulent, threatening, obscene, or unlawful

You grant JeffCo Home Pros a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, display, publish, and distribute submitted content for operating, improving, and promoting our services.

We may remove or decline to publish submitted content at our discretion.

15. Third-Party Websites and Services

The website may contain links to contractor websites, social-media platforms, manufacturers, financing providers, or other third-party services.

JeffCo Home Pros does not control and is not responsible for third-party websites, products, services, content, terms, or privacy practices. Accessing third-party resources is at your own risk.

16. Website Availability and Accuracy

We attempt to provide useful and accurate information, but website content may contain errors, omissions, or outdated information.

We may modify, suspend, discontinue, or restrict any part of the website or referral service without notice. We do not guarantee that the website will always be available, secure, accurate, complete, or free from harmful components.

17. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND OUR REFERRAL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

JEFFCO HOME PROS DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT OR GUARANTEE ANY CONTRACTOR, ESTIMATE, PRICE, SERVICE, PRODUCT, MATERIAL, WARRANTY, OR PROJECT OUTCOME.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JEFFCO HOME PROS AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM:

• Your use of or inability to use the website
• A contractor referral
• Your decision to hire or not hire a contractor
• A contractor’s acts, omissions, work, materials, employees, or subcontractors
• Property damage, personal injury, financial loss, delay, or project failure
• Unauthorized access to or use of website information
• Third-party websites or services

To the fullest extent permitted by law, JeffCo Home Pros’ total aggregate liability arising from the website or referral services will not exceed the greater of $100 or the amount you paid directly to JeffCo Home Pros for the applicable referral service during the preceding 12 months.

These limitations do not exclude liability that cannot legally be excluded or limited.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless JeffCo Home Pros and its owners, officers, employees, representatives, and service providers from claims, damages, losses, liabilities, judgments, costs, and expenses—including reasonable attorneys’ fees—arising from:

• Your misuse of the website or referral service
• Your violation of these Terms
• False or unauthorized information you submit
• Content you provide
• Your violation of another party’s rights
• Your unlawful or fraudulent conduct

20. Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Subject to applicable law, legal proceedings arising from these Terms, the website, or JeffCo Home Pros’ referral services must be brought in a court of competent jurisdiction located in Jefferson County, Alabama. You consent to the jurisdiction and venue of those courts.

Your separate agreement with a contractor may contain different dispute-resolution terms that apply to disputes between you and that contractor.

21. Changes to These Terms

We may update these Terms periodically. Revised Terms will be posted on the website with an updated “Last Updated” date.

Changes apply prospectively from the date they are posted. Your continued use of the website or referral services after revised Terms are posted constitutes acceptance of those changes.

22. Severability

If any provision of these Terms is found unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will remain in effect.

23. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

24. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and JeffCo Home Pros concerning your use of the public website and referral services, unless a separate written agreement applies.
